1. Introduction

Welcome to Solaya Coliving. These Terms of Service ("Terms") govern your use of our website and services, including bookings and stays at our coliving villa located in Bang Por, Koh Samui, Thailand.

By accessing our website, making a booking, or staying at Solaya Coliving, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services. These Terms are subject to Thai law and regulations governing accommodation services.

2. Definitions

  • "Solaya," "we," "us," "our": Refers to Solaya Coliving and its operators
  • "Guest," "you," "your": Refers to any person who books or stays at our property
  • "Property": Refers to Solaya Coliving villa located in Bang Por, Koh Samui, Thailand
  • "Suite": Refers to individual accommodation units (THE VISTA, THE FLOW, THE HAVEN)
  • "Booking": Refers to a reservation for accommodation at our property
  • "Stay Period": Refers to the duration of your accommodation booking

3. Minimum Stay Requirement

In compliance with Thai law and regulations governing accommodation services, all bookings at Solaya Coliving require a minimum stay period of 30 (thirty) consecutive days.

This requirement is mandatory under Thai legislation (Hotel Act B.E. 2547 and related regulations) which distinguishes between short-term hotel stays and longer-term residential accommodation. As a coliving facility, we operate under regulations that require minimum 30-day stays.

Bookings for periods shorter than 30 days will not be accepted. Any attempt to book for less than 30 days will result in automatic cancellation or rejection of the booking request.

4. Booking and Payment Terms

4.1 Booking Process

  • All bookings are subject to availability and confirmation by Solaya Coliving
  • Bookings must be made through our official website or direct communication channels
  • You must provide accurate and complete information during the booking process
  • We reserve the right to refuse any booking at our discretion

4.2 Payment Terms

  • Payment is required in Thai Baht (THB) unless otherwise agreed
  • A deposit or full payment may be required to confirm your booking
  • Payment methods accepted include bank transfer, credit card, or other agreed methods
  • All prices are subject to change without notice until booking is confirmed
  • Prices include applicable taxes as required by Thai law

4.3 Pricing

Rates are displayed per month and may vary based on season, suite type, and length of stay. All prices are in Thai Baht and are subject to applicable taxes and fees as required by Thai regulations.

5. Cancellation and Refund Policy

5.1 Guest Cancellation

Cancellation requests must be submitted in writing via email to solayacoliving@gmail.com.

  • If your suite can be rebooked: You will receive a refund minus a 2,000 THB administrative fee
  • If your suite cannot be rebooked: Bookings are non-refundable
  • Transfer or Reschedule: You may transfer or reschedule your booking once, subject to availability and season
  • No-show: No refund will be provided for no-shows or early departures

5.2 Our Cancellation Rights

We reserve the right to cancel your booking in the following circumstances:

  • Non-payment of required deposits or fees
  • Violation of these Terms or house rules
  • Force majeure events (natural disasters, government restrictions, etc.)
  • Property maintenance or safety issues

In case of cancellation by us (except for guest violations), we will provide a full refund or offer alternative accommodation dates.

6. Guest Obligations and House Rules

6.1 Legal Requirements

  • All guests must provide valid identification (passport for international guests, ID for Thai nationals) as required by Thai law
  • Guests must comply with all Thai immigration and visa requirements
  • Guests must register with local authorities as required by accommodation regulations
  • Guests must have valid travel insurance covering their stay period

6.2 Conduct and Behavior

  • Respect other guests, neighbors, and the local community
  • Maintain quiet hours (typically 10 PM to 7 AM)
  • No smoking inside suites or common areas (designated outdoor areas only)
  • No illegal activities or substances on the property
  • Proper use and care of property facilities and amenities
  • Report any damages or maintenance issues immediately

6.3 Capacity and Occupancy

Each suite is designed for 1-2 guests maximum. Additional guests or visitors must be approved in advance and may incur additional charges. Overnight visitors are subject to approval and may require additional registration.

7. Property and Facilities

7.1 Included Amenities

Your stay includes access to:

  • Private suite with en-suite bathroom
  • King-size bed and personal workspace
  • High-speed Wi-Fi
  • Air conditioning or eco-friendly fans
  • Shared infinity pool
  • Shared kitchen facilities
  • Lush garden and common areas
  • Filtered water
  • Linens and towels (please bring your own beach towel)

7.2 Property Maintenance

We reserve the right to enter suites for maintenance, repairs, or safety inspections with reasonable notice (except in emergencies). Regular cleaning of common areas will occur, and suite cleaning schedules will be communicated.

8. Liability and Insurance

8.1 Our Liability

To the maximum extent permitted by Thai law:

  • Our liability is limited to the amount paid for your stay
  • We are not liable for loss or damage to personal belongings
  • We are not liable for indirect, consequential, or special damages
  • We are not liable for events beyond our reasonable control

8.2 Guest Insurance

Guests are strongly advised to maintain comprehensive travel and health insurance covering their entire stay period, including medical expenses, trip cancellation, and personal belongings.

8.3 Damage to Property

Guests are responsible for any damage to the property, suites, or facilities caused by their actions, negligence, or that of their visitors. Repair or replacement costs will be charged to the guest.

9. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or health emergencies
  • Government restrictions, travel bans, or regulations
  • War, terrorism, or civil unrest
  • Utility failures or infrastructure issues
  • Acts of God or other unforeseeable events

In such cases, we will work with guests to find reasonable solutions, including refunds or rescheduling where possible.

10. Intellectual Property

All content on our website, including text, images, logos, and design, is the property of Solaya Coliving and protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

11. Dispute Resolution

These Terms are governed by the laws of Thailand. Any disputes arising from these Terms or your stay at Solaya Coliving shall be subject to the exclusive jurisdiction of the courts of Surat Thani Province, Thailand.

We encourage resolution of disputes through direct communication. If a dispute cannot be resolved amicably, parties agree to attempt mediation before pursuing legal action.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to guests with active bookings. Continued use of our services after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable under Thai law, the remaining provisions shall remain in full force and effect.
